Boundary Disputes – The easy way to start a war

Boundary disputes are never a good idea and can work out very expensive. If you do have a boundary dispute do some research first before confronting your neighbour with all guns blazing.
The key to resolving a dispute speedily and successfully is to employ an expert as soon as possible. Each side can use an independent expert to work out where the boundary lies and write a report. This often resolves the dispute quickly and simply.
- Try and establish the previous position of the boundary with aerial or satellite photography
- See if the Land Registry can help with plans that might show the position of the boundary. Land Registry plans are a good starting point but often only show the general boundary. The new Land Registration Act of 2002 allows you to determine the exact line of boundaries on your registered title, so avoiding future disputes
- Public records such as the planning department of the local council might have records showing boundary positions
If you can’t agree and the area of land is sizeable then appoint a Chartered Surveyor and solicitor to act on your behalf to find out whether or not you have a strong case.
